Hardscaping Services, Sales and Returns

  1. Hardscaping Services Listings.

    Contractor may create Hardscaping Services Listings through the Services by uploading Submissions in connection with your Hardscaping Services offerings (each a “Hardscaping Services Listing”). Contractor acknowledges that HireScapes is not a party to any sale of any Hardscaping Services between Contractor and its customer, and that Contractor is solely responsible for the accuracy and completeness of all Hardscaping Services Listings. Contractor warrants to HireScapes and its customers that all Submissions in any Hardscaping Services Listings will comply with the Terms.

  2. Eligible Hardscaping Services.

    Contractor may list and sell any Hardscaping Services that (i) are associated with the hardscaping industry and (ii) are not illegal in the United States. Contractor is solely responsible for compliance with all applicable laws relating to the advertisement, sale, export compliance and shipping of all Hardscaping Services.

  3. Warranty; Repeat Complaints.

    Contractor shall offer a full warranty not shorter than one-hundred and eighty (180) days from the time of sale on all Hardscaping Services sold via the Services. If Contractor experiences repeated returns of or complaints about Hardscaping Services or HireScapes receives multiple complaints regarding Contractor, HireScapes may temporarily or permanently ban Contractor from access and use of the Services.   4. Returns, Exchanges and Refunds.

    Contractor must, at a minimum, and where applicable, offer customers the ability to exchange a Hardscaping Services or return it for a full refund in the event that the Hardscaping Services is (i) defective or becomes defective within 30 days of sale and (ii) not as described in the Hardscaping Services Listing. Contractor may, at its option, include additional return, refund and exchange terms. All return, refund and exchange terms (including the default terms set forth in (i) and (ii) herein) must be stated clearly and prominently in each Hardscaping Services Listing. HireScapes reserves the right to remove any Hardscaping Services Listing that does not conform with the obligations of these Terms.

Fees

Fees and Payments

Contractor hereby authorizes HireScapes to credit, through a Payment Processor, Contractor’s payment card or account for the sales amount of each Hardscaping Services, less any service charges, Hardscaping Services Listing fees and Payment Processor charges. A list of service charges and Hardscaping Services Listing fees can be found here [INSERT LINK TO FEES PAGE]. The Hardscaping Services Listing fees schedule may vary in the future. Contractor must have a payment method on file when selling on the Services and pay all fees and applicable taxes associated therewith. It is Contractor’s responsibility to determine whether taxes apply to the transaction and to collect, report, and remit the correct taxes to the appropriate tax authority. Contractor agrees that HireScapes is not obligated to determine whether taxes apply and is not responsible to collect, report, and remit any sales, use, or similar taxes arising from any transaction.

Additional Indemnification Obligations.

  1. Contractor Indemnity

    Contractor shall indemnify, defend, and hold harmless HireScapes and the HireScapes Parties from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) incurred by HireScapes as a result of any claim, judgment, or adjudication against HireScapes arising from any claim relating to (i) any Hardscaping Services or content sold or made available via the Services, including without limitation any claim related to injury, dismemberment, disability or death and any claim that any Hardscaping Services or content infringes any third-party intellectual property rights, violates any applicable law or is defective or dangerous; and (ii) Contractor’s own website or other sales channels, the content Contractor provides, and the advertisement, offer, sale or return of any Hardscaping Services sold.

  2. Additional Obligation

    The terms of this Section 3 shall be in addition to the indemnification obligations of the parties set forth in Section 14 of the Terms of Use.
